| Legislation DiscovaCam Limited (DiscovaCam) is a New Zealand registered limited liability company with its registered head office in Auckland, New Zealand, and as such, is governed by New Zealand laws. The company was incorporated under the Companies Act 1993 which, together with the Securities Act 1978 and Securities Markets Act 1988, defines rights and duties for directors, management and shareholders. DiscovaCam’s constitution and the list of current directors are available online through the Companies Office of the New Zealand Government. The Fair Trading Act 1986 protects commercial and consumer customers against false or misleading statements. The New Zealand Government agency tasked with competition watchdog duties, the Commerce Commission, monitors New Zealand corporate activity and follows up on complaints. Complainants can also access the Court directly to seek damages relating to a breach of this Act. Further information is available from the Commerce Commission. The Consumer Guarantees Act 1993 is an additional protection available only to individuals as a consumer. The Act does not protect any person or organisations acting in a business or public service activity. This Act guarantees that the product or service is suitable for the purpose for which it has been supplied. If a DiscovaCam unit is supplied in a damaged state, then the Act provides the consumer the right to demand from their supplier for a refund, replacement or repair, at the supplier’s discretion. However, this Act only applies to purchases within New Zealand, and hence, any purchases from a DiscovaCam Agent to a consumer both outside of New Zealand is governed by local laws. The Privacy Act 1993 is similar to European Union privacy law and provides rights to privacy for customers, suppliers and staff. Information received by DiscovaCam may only be used for the purpose for which it was provided. Complaints regarding abuse of these privacy provisions can be lodged with DiscovaCam’s Privacy Manager, and, if you are not satisfied with the company’s response, with the Privacy Commissioner. DiscovaCam’s customers around the world have access to the legal protection through the Commerce Commission and the Privacy Commissioner, and hence have a legal framework for support in the unlikely event of problems with DiscovaCam or its products. |
